Chapter A: General section concerning all types of cleaning services and products

Chapter A: General section concerning all types of cleaning services.
Article 1. Definitions
In these general terms and conditions, the following definitions shall apply:
Contractor: the cleaning and window cleaning company which, as user, declares these GTC applicable in its Contracts;
AVG: (European) General Data Protection Regulation;
AVB: corporate liability insurance.
GTC: these general terms and conditions;
CAO: the Collective Labor Agreement in the Cleaning and Window Cleaning Business
Services: Cleaning and window cleaning activities such as cleaning, emptying, disinfection, of Objects in the broadest sense of the word including, for example, Industrial cleaning: Including the removal, disposal and processing (or having processed) of contamination, deposits and the like in the broadest sense of the word, of or in industrial buildings, installations, warehouses. Facade, floor and glass cleaning: Including the removal of applied or atmospheric-induced soiling from vertical and/or horizontal surfaces, regardless of material type or structure, as well as the application of protective, repellent and/or impregnating coats to said surfaces. Calamity cleaning: Including the salvaging, cleaning and/or reconditioning of buildings, stocks, machinery and/or inventory after a calamity in the broadest sense of the word. Janitor or handyman services: Including ensuring a clean and safe living and living environment in the Objects and supervising the execution of activities in the field of cleaning, maintenance and (technical) management of the Object; Auxiliary materials: means deployed by Contractor for the benefit of the Work such as cleaning agents and materials, aerial platforms, operating equipment and machines, etc. Information: all information, data, materials and instructions received from Principal or from third parties at the request of Principal, including information about the Object and the surfaces to be cleaned in connection therewith. Object: the object of the Work, including but not limited to the interior and exterior of a building, such as floors, facades, windows, the interior and exterior of a ship, clean rooms, a bus, a train, plumbing, a means of production, a slaughterhouse, a factory, an industrial site, a plant, inventory, and/or any other movable or immovable property, etc. Client: the natural person or legal entity that enters into an Agreement with the Contractor; Agreement: any contract of assignment between the Parties for the delivery of Products and Services, including the Work Programme, any written amendment or addition to the Agreement, tacit extensions thereof, as well as all factual and legal acts in preparation and execution of that Agreement, including verbal and written offers from the Contractor; Parties: Contractor and Client; Products: Cleaning agents, equipment, machines, installations, (sanitary) utilities, etc. which are related to the Services in the broadest sense of the word and are sold or rented to the Client. Work: all acts and operations to be performed by the Contractor on behalf of the Client which are useful and necessary to provide the Services as described in the Agreement Work schedule: an overview (work order or similar) that forms part of the Agreement and on which the Contractor, in consultation with the Client, indicates the Work in as much detail as possible, if possible stating the location, time and frequency of the Work, etc., including the preparatory measures for this and the price
Article 2. Grade
Section A applies to delivery of all Work and Products by Contractor. If the content or interpretation of the Order Confirmation and the GTC conflict with each other, the content of the Order Confirmation shall prevail. If the contents or explanations of Chapter A and B conflict with each other, Chapter B shall prevail over Chapter A if the Services from Chapter B apply.
Article 3. General provisions
Section A applies to delivery of all Work and Products by Contractor. If the content or interpretation of the Order Confirmation and the GTC conflict with each other, the content of the Order Confirmation shall prevail. If the contents or explanations of Chapter A and B conflict with each other, Chapter B will take precedence over Chapter A if the Services from Chapter B apply.
Article 4. Offer and acceptance, formation of Agreement.
Section A applies to delivery of all Work and Products by Contractor. If the contents or interpretation of the Order Confirmation and the GTC conflict with each other, the contents of the Order Confirmation shall prevail. If the contents or explanations of Chapter A and B conflict with each other, Chapter B shall prevail over Chapter A if the Services from Chapter B apply.
Article 5. Implementation of Agreement and Work Program by Contractor.
Section A applies to delivery of all Work and Products by Contractor. If the content or interpretation of the Order Confirmation and the GTC conflict with each other, the content of the Order Confirmation shall prevail. If the contents or explanations of Chapter A and B conflict with each other, Chapter B will take precedence over Chapter A if the Services from Chapter B apply.
Article 6. Compliance and Monitoring Work Program.
Section A applies to delivery of all Work and Products by Contractor. If the contents or interpretation of the Order Confirmation and the GTC conflict with each other, the contents of the Order Confirmation shall prevail. If the contents or explanations of Chapter A and B conflict with each other, Chapter B will take precedence over Chapter A if the Services from Chapter B apply.
Section B: Additional conditions Glass cleaning, facade cleaning and floor maintenance.
